Today’s quote comes to us from Supreme Court Justice Elana Kagan. It involves the issue of whether individual federal judges can make rulings that affect nationwide policy.
Here it is:
“It just can’t be right that one district judge can stop a nationwide policy in its tracks and leave it stopped for the years that it takes to go through the normal process.”
So she must have been one of the majority-view justices in the 6-3 decision to severely limit individual Federal judges from rulings which stop nationwide policies, right?
Wrong.
Justice Kagan made that comment on September 14, 2022, when Joe Biden was President and such rulings would prevent him (or whoever was actually running the country) from making presidential decisions.
But now that Donald Trump is President? She is one of the three dissenting justices.
