Today’s quote comes from Benjamin Brafman, the lawyer who is defending harvey weinstein.
This, so help me, is Mr. Brafman’s explanation of weinstein’s behavior:
“Mr. Weinstein did not invent the casting couch in Hollywood. To the extent that there’s bad behavior in that industry, that is not what this is about. Bad behavior is not on trial in this case.”
Wow, Brafman is floating the “he didn’t invent the crimes he committed” defense.
Brilliant. Just brilliant. With a defense like that, why even hold a trial? Why not let weinstein just walk free. After all, if he is not the first person to commit a crime he isn’t responsible, right?
In that regard, I have a question for Mr. Brafman.
If – and I certainly don’t in any way wish that this would happen – a career criminal with a long history of violence attacks you in front of your home, beats the living excrement out of you, steals your wallet and keys, then enters your home and does the same, maybe even worse, to members of your family…
….what if his defense is “I didn’t invent violent crime”?
Will you ask that the charges be dropped, and send him on his way with your good wishes?
I award Benjamin Brafman Quote Of The Day “honors” in the hope that he will reflect on the answer he would give to that question, and then apply it to harvey weinstein.



With all the money harvey has you would think he would have hired a smart attorney. And in a trial the attorney’s name makes a difference, barf man is not a winning name.
