SHOULD PRESIDENT OBAMA NOMINATE A REPLACEMENT FOR ANTONIN SCALIA?

Ken Berwitz

Incredibly, the question posed in that title is being raised.

Let me put this one to bed right now.

Barack Obama is the President of the United States.  He is 100% within his rights to nominate anyone he chooses to replace the late Antonin Scalia on the Supreme Court.

And the United States Senate is 100% within its rights to accept or reject Mr. Obama\’s nominee.

No one who reads this blog has any doubt that I am highly critical of Barack Obama\’s performance as President.  But that does not, in any way, change the fact that he is our President, or what he, as President, is within his rights to do.

End of issue.
