Inhis decision, U.S. District Judge Ronald White concluded Tuesdaythat the IRS rule altering the Obamacare law and providing billionsin subsidies is “arbitrary, capricious and abuse of discretion”:
“Thecourt holds that the IRS rule is arbitrary, capricious, andabuse of discretion or otherwise not in accordance with law,pursuant to 5 U.S.C.706(2)(A), in excess of summary jurisdiction,authority or limitation, or short of statutory right, pursuant to 5U.S.C. 706(2)(C), or otherwise is an invalidation of the ACA[Affordable Care Act], and is hereby vacated. The court\’s order ofvacatur is stayed, however, pending resolution of any appeal fromthis order.”
“Today\’sruling is a consequential victory for the rule of law. Theadministration and its bureaucrats in the IRS handed out billions inillegal tax credits and subsidies and vastly expanded the reach ofthe health care law because they didn\’t like the way Congress wrotethe Affordable Care Act. That\’s not how our system of governmentworks.”
You probably won\’t read much about this mega-takedown of the administration\’s illegal actions regarding ObamaCare, other than here. Partly because there are too many other administration disasters going on simultaneously for it to rate high enough, and partly because, even if there weren\’t, Mr. Obama\’s Accomplice Media would try to bury it, as they have buried so much other bad news about ObamaCare.
This is hands-down, the most inept, incompetent, dishonest, administration in my lifetime. Maybe in anyone\’s lifetime.
