The absolute best article I have read on this subject is by Clarice Feldman, writing for americanthinker.com.
It starts with a reminder that Barack Obama regularly ignored court orders and regularly exceeded his constitutional authority as president – with no repercussions, of course.
It then questions Chief Justice John Roberts’ genuinely bizarre decision to disallow the citizenship question on 2020 census forms – for a reason that a) seems irrelevant to me and b) in any case, appears easily overcome…but, due to the timing, makes it almost impossible for that to happen before the census forms are printed and sent out. In other words, Roberts seems to have intentionally created an effective veto of the question, regardless of whether it is asked constitutionally.
Ms. Feldman’s key paragraph:
Oddly, Chief Justice Roberts took issue with the notion that these usurpers are Obama judges, claiming the federal judiciary is politically neutral. I say oddly, because twice Roberts has not been politically neutral — once in affirming the constitutionality of ObamaCare’s mandatory insurance on grounds not argued by the government and now in deciding that including a question about citizenship while constitutionally permissible and done according to the relevant statutes might have been done for an undeclared motive, partisan advantage. By waiting until the last day of the term to announce his decision, he in effect gave himself a pocket veto. This is so because the time for printing the forms was so close and the census due to begin in October, shortly after the court returns for a new term. Though the case was remanded to take evidence about the purpose of the question it is likely the conclusion of that exercise below which would certainly return to his court could not be resolved in time by the Roberts’ court.
Ms. Feldman then goes on to quote legal scholar after legal scholar on this subject.
I don’t know how anyone can think they understand the ins and outs of this issue without reading Ms. Feldman’s article. It it that good.
I strongly urge you to use the link I’ve provided and read every word.
And I strongly urge the President to hold up printing those forms until this is finally decided.
Censuses are not time-sensitive entities. They are taken every ten years. If one of them holds up for a month or two, to insure it is done correctly, what’s the problem?
